Terms and Conditions
"The Company" means Evolution Auto Detailing Limited, registered in England and Wales as Company Number 6338379……….
- "The Customer" means the person, firm or company offering to buy goods from the Company.
- "The Goods" means the goods or materials that the Customer is buying or offering to buy.
1. General
The Customer should check product suitability before ordering. The Customer must not buy, sell or use products if they are in any way uncertain. Do not alter or change the products or sell, pass on or use in any way that the manufacturer has not specifically agreed to. Do not infringe copyright. If you are in any way unsure of your legal position, seek independent legal advice.
2. Customer Details
The customer is responsible for completing full order details: name, billing address as it appears on the card statement address, delivery address, email contact and associated contact numbers to the fullest. This will ensure that all orders are processed in a timely manner. The details EAD request are processed through a verification service and failure to provide accurate details may cause a delay in processing and dispatching an order.
3. Quotations
Every quotation is subject to change without notice. The Company reserves the right to withdraw after acceptance by the Customer where the Company is not satisfied to the Customers credit worthiness.
4. Prices
All orders are accepted and quotations are given at prices offered when the order is accepted or the quotation given. The Company reserves the right to increase to the prices offered at the date of dispatch. The Company reserves the right to increase prices in the event of increases in any directly attributable cost. The Company reserves the right to amend prices to correct errors or emissions.
5. Delivery
Delivery is calculated on the weight and destination address of your order. These charges will be confirmed as you proceed through the checkout. Delivery dates are promises given in good faith by The Company to indicate estimated delivery times but shall not amount to any contractual obligation to deliver at the time stated. The Company will accept no liability for, or consequential loss, or damage arising from delay in delivery. Goods are dispatched via various recognized carriers. It is the Customer's responsibility to check all goods for damage before signing for acceptance of said goods. Once goods are signed for The Company will not admit any liability for damage.
EAD generally dispatch orders for next day delivery before 5pm, during normal working hours. If the customer is unable to receive the delivery, a card will be left. After two failed deliveries a further charge of £5 will be made for each further delivery attempt. It is the customer's responsibility to pay any additional charges and request for payment will be made by email prior to any further delivery attempts. Saturday morning deliveries can be made with prior arrangement and at an additional cost of £25.
If deliveries cannot be made and fail due to no contact with the delivery company and are then returned to our office, a charge of £25 will be made to cover the return postage and packaging before the goods are resent. If the customer changes the delivery address once the consignment has been dispatched, a further charge of £10 will be made to cover the change of address.
EAD will use its reasonable endeavors to deliver within 5 days of receipt of the Customer's order subject to stock. Generally orders are dispatched same day if the order is placed before 1 pm, subject to stock.
6. Non-Delivery
EAD will not accept liability for goods lost in transit unless we are notified within 5 days of the expected delivery date. We shall accept no liability for shortages, non deliveries, incorrect goods and goods damaged on delivery outside the reported time scales.
7. Damage in Transit
The Company will repair or replace free of charge goods damaged in transit provided that The Company receive written notification of such damage within two days of delivery. Goods received in a damaged or unsatisfactory condition must be signed for as such. On receipt, goods should be checked with the advice note enclosed with the goods. Shortage claims will only be considered if The Company receives written notification of such shortage within 24 hours of delivery, failing which no liability will be admitted. The packing and contents should be retained for inspection.
8. Damaged Goods
Should any damage be indentified upon opening the package EAD must be advised within 48 hours of the exact damage. It is imperative that the customer does not dispose of any of the packaging as this will be required to affect a claim against the carrier. We cannot accept any claims for damage if the above time scales are not followed.
9. Incorrect Goods
It is the customers responsible to notify us of any incorrect goods supplied within 48 hours of delivery. If the items are not as ordered, the customer must not open the manufacturers packaging or use the item. The customer will also be required to provide further information on what was received, i.e. we may require the manufacturer’s part codes and a full description of what has been received. Should there be any extenuating circumstances which have prohibited the customer to remain within the specified time frame; resolution will be by mutual decision.
10. Cancellations
The Customer has no right of cancellation of an order in whole or in part except with the Companies consent. The Company reserves the right to charge a restocking fee of 15% when cancellation of an order has been agreed.
11. Transfer of Property
The goods shall remain the property of the Company until the Company has received payment in full for the goods and the Customer will not pledge, charge or otherwise encumber the goods until the payment has been made in full.
12. Return Of Goods
Goods to be returned must be notified to The Company within two days of receipt of goods by the customer, as goods correctly supplied may not be returned without The Company agreement. Goods so returned must be consigned (carriage paid) and accompanied by a packing note stating the Company invoice number and date thereof together with the reason for return.
Please use a recorded delivery service where a signature must be obtained to avoid delay and lose of your parcel. Returns cannot be accepted without prior authorization and returns authorization. The returns authorization is valid for up to 14 days only. Goods sent back without prior returns authorization will be returned back to you and the cost of delivery charged to your account. A restocking charge of 15% will be imposed.
A full refund of the cost of the goods is wholly conditional upon the conditions being met below and the refund authorized only after a full inspection of the goods by us.
The goods must to returned ‘AS SOLD’ in the original packaging with all components and accessories. The goods must be complete, unused and in ‘AS NEW’ condition. If you have opened the box to examine the product, it must be done so without damaging the box, packaging or damaging the product in any way and must be repackaged as received. Any ‘FREE GIFTS’ with the products must be returned. Once completion of the return had occurred and the conditions have been met. However please be aware this can be up 14 days. Once any monies are credited they are normally available for viewing on your next statement.
13. Data Protection
The Customer agrees that The Company may put its name and other details obtained from the order form into a computerized database for The Company’s use and to enable The Company to provide the service unless the Customer gives specific written instructions to the contrary.
Customer information is not shared nor used for purposes other than order fulfillment and ongoing product development.
14. Warranty
Goods are warranted by the Company or authorized third party to the Customer against defects in workmanship and material during the applicable warranty period.
14 i. Disclaimer of Warranties
Except for the express warranties stated above, the Company disclaims all other warranties or conditions whether express or implied in law.
15. Electronic communication
When you visit the EAD or send e-mails to us, you are communicating with us electronically, you consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
16. Copyright
All content included on this site, such as text, graphics, logos, button icons, images, and audio clips, digital downloads, data compilations, and software, is the property of EAD or its content/intellectual suppliers and protected by United Kingdom and international copyright laws. The compilation of all content on this site is the exclusive property of EAD or its intellectual owner.
17. Your Membership Account
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use our website only with involvement of a parent or guardian. EAD reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.
18. Export
If you are requesting delivery to a country outside of the UK, you may be subject to addition charges for customs clearance. This must be borne by the customer. We have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country. You should contact your local customs office for further information. Additionally, when ordering from Evolution Auto Detailing you are considered the importer of record and must comply with all laws and regulations of the country of which you are receiving the goods.
